Escalating Tensions: The Humanitarian Crisis in Gaza
As the conflict in Gaza intensifies with significant airstrikes, the hope for peace established by a two-month ceasefire earlier this year feels like a fading memory. More than 19 months into conflict, Israel’s military objectives remain consistent, focusing on the defeat of Hamas and securing the release of Israeli hostages. However, the question looms—how can military defeat be achieved without an unconditional surrender from Hamas?
Reports indicate that Hamas continues to hold approximately 57 Israeli hostages, with 24 believed to be alive, insisting on guarantees for an end to the conflict before further negotiations regarding hostage releases can occur.
18 Years of Blockade
In a move that has generated extensive discussion, Israel announced that it will permit a limited amount of food aid into Gaza following a nearly three-month blockade. Unfortunately, the details regarding when or how this humanitarian relief will be delivered remain unclear amid reports of escalating military operations.
The blockade, first instituted in 2007 following Hamas’s rise to power, has severely restricted the movement of goods and people, tightening particularly after Hamas’s attacks on October 7, 2023. The ceasefire in January temporarily increased the flow of humanitarian aid, but that relief was short-lived, as Israeli Prime Minister Netanyahu subsequently cut off aid to pressure Hamas for hostages.
According to the United Nations, humanitarian efforts in Gaza have now reached a “near-standstill,” with alarming reports highlighting that 2.1 million Palestinians face potential famine, with one in five at risk of starvation. Israel denies any shortages, maintaining that aid cannot enter without a system to ensure it does not benefit Hamas.
The Legal Framework
International law explicitly prohibits the use of starvation as a method of warfare, a point reiterated by both the 1949 Geneva Conventions and the Rome Statute of the International Criminal Court (ICC). Tom Fletcher, the UN’s emergency relief coordinator, highlighted Israel’s responsibilities under international humanitarian law not to condition aid on military or political objectives.
International courts are also addressing these obligations. In November 2024, the ICC issued arrest warrants for key figures in Israel’s government in response to allegations of intentionally depriving the civilian population in Gaza of necessities. However, the lack of enforcement mechanisms due to Israel’s non-participation in the Rome Statute complicates the situation.
Moving Forward
The International Court of Justice (ICJ) continues to hear critical cases regarding humanitarian obligations in Gaza. Recent provisional measures called on Israel to cease military operations and facilitate the unobstructed delivery of humanitarian assistance. Despite the pressures from courts and international entities, Israel’s blockade remains a significant barrier to aid.
Fletcher concluded at the UN that rising tensions reflect a degradation of international law, threatening the progress made over decades to protect civilians. The ongoing geopolitical wrestling over Gaza illustrates the complexities of enforcing international norms, particularly amid steadfast support for Israel from powerful nations.
As the international community reflects on inadequacies in addressing humanitarian needs, many remain hopeful that diplomatic pressure can pave the way for a resolution that honors the dignity and rights of all individuals, regardless of their nationality or beliefs.
Every day adds to the urgency of this humanitarian crisis, and it is essential for the international community to continue advocating for peace and equitable solutions for all affected.
