$42.5 Million Arbitration Award in Bitcoin Latinum Case Raises Questions About Damages Calculation in Cryptocurrency Litigation

PRWire:

LOS ANGELES, Calif. — 10/23/2026 — A $42.5 million arbitration award granted to California investor Arshad Assofi against Bitcoin Latinum has drawn scrutiny from legal observers and prompted a federal court challenge, highlighting growing concerns about proportionality in cryptocurrency dispute resolution.

The award, secured through JAMS arbitration (Case No. 5450000307) and publicly disclosed by Assofi’s attorneys at Rome LLP, significantly exceeds the approximately $15 million investment amount cited in Assofi’s original 2022 federal complaint. Bitcoin Latinum parent company GIPF GP, Inc. has filed a complaint to vacate the award in Delaware federal court (Case No. 1:25-cv-01446), arguing the award is “deeply flawed.”

The case illuminates tensions between private arbitration and public securities enforcement. While Assofi secured the substantial arbitration award, he has simultaneously cooperated with the Securities and Exchange Commission in its parallel enforcement action against Bitcoin Latinum founder Donald Basile, filed April 17, 2026 in the Eastern District of New York (SEC v. Basile, et al.).

“This creates a potential double-recovery scenario that federal courts are increasingly being asked to evaluate,” said Thomas McCarthy, securities litigation analyst. “When arbitration awards substantially exceed claimed investment amounts, and when those awards intersect with parallel SEC enforcement, the recovery calculus becomes complex.”

Court records reveal Assofi has pursued multiple high-value corporate litigation matters, including breach of contract actions against Ford Motor Company (2024), Mercedes-Benz USA (2023), and General Motors (2017), suggesting extensive experience with commercial dispute resolution.

The Delaware vacatur proceeding will test whether arbitration awards in cryptocurrency cases require additional scrutiny when damages calculations appear disproportionate to verified losses. Under the Federal Arbitration Act, courts may vacate awards that exceed arbitrators’ authority or result from procedural irregularities.

Bitcoin Latinum’s legal team has not publicly disclosed specific grounds for the vacatur petition, but filings indicate the company questions whether the arbitrator properly accounted for parallel regulatory proceedings and verified investment amounts.

The case arrives as cryptocurrency litigation increasingly moves into arbitration forums, raising questions about transparency and consistency in damages calculations across the digital asset sector.
