‘8 Guidelines for Implementing AI Systems in the Workplace’

The U.S. Department of Labor and The White House have introduced a new framework to safeguard American workers from potential negative impacts of artificial intelligence (AI) systems in the workplace. This framework outlines eight essential principles for the development and implementation of AI systems in work environments, with some principles aligning with existing privacy laws and Federal Trade Commission guidance.

One key principle is to prioritize worker empowerment, ensuring that workers and their representatives, particularly from marginalized communities, are involved in the design, testing, and oversight of AI systems in the workplace. This mirrors requirements in GDPR and U.S. state laws related to Data Protection Impact Assessments (DPIA).

Another crucial principle is ethical development of AI, emphasizing the need to safeguard workers in the design and training of AI systems. Additionally, the framework highlights the importance of establishing AI governance and human oversight, akin to privacy laws’ opt-out requirements.

Transparency in AI use, protection of labor and employment rights, and responsible handling of worker data are also key principles in the framework. These elements emphasize the need for openness in AI applications, protection of workers’ rights, and responsible data use in line with existing privacy laws.

The framework also emphasizes using AI to empower workers, supporting those impacted by AI, and ensuring responsible utilization of worker data. It underscores the importance of limiting the scope and location of worker data collected by AI systems, utilizing it for legitimate business purposes, and handling it responsibly, aligning with data minimization and compatible purpose requirements in privacy laws.
